Three types of product defects can give rise to a product liability claim:

  • A Design Defect – This occurs when a product line is designed in such a manner as to be unsafe for reasonable use.
  • A Manufacturing Defect-This occurs when an individual product in a larger product line in manufactured in a way that makes it unfit for reasonably safe use.
  • A Defective Warning-This occurs when a product does not provide a sufficient warning, either through labeling or package insert, such that the product can be used safely.
  • A manufacturer can also be liable for negligence. The manufacturer of a product has a duty to use reasonable care in the design, manufacturing, testing, and inspection of the product to see that the product is safe for any reasonably foreseeable use. The failure to fulfill this duty is negligence. In a negligent product liability case the focus is on the manufacture’s conduct and the product.
